Five tips to avoid the long walk of shame

It can happen to anyone, even film legend Ben Affleck. On April 28, he was playing blackjack at the Hard Rock Casino in Las Vegas. According to Variety, Ben was approached by a casino rep who told him, “You’re too good at this game.” That’s a nice way of saying, “You’re counting cards.” Then the casino declined his action, effectively banning Ben from the blackjack tables. They called him a car, and he left the property.
Some news sources reported that Ben was banned from the Hard Rock, but a few days later, the Las Vegas Review-Journal got a clarification from Abigail Miller, a hotel rep. She said, “Mr. Affleck, a valued guest of Hard Rock Hotel & Casino, is not banned from our property and is welcome back any time.” Nice, but is Ben still banned from playing blackjack? She didn’t say.
How did this happen? Can it happen to you? The short answer is yes. Counting cards at blackjack is just one example. Roulette, craps, poker,—all table games are potential breeding grounds for situations that can land you on the pavement, especially if you’re an advantage player. Here’s what you can do to make that less likely.
1. Don’t be so obvious.
One week prior to his adventure at the Hard Rock, Ben was playing blackjack at Wynn. A rep there told him to curb his action. Rob Olivetti, games protection manager at Wynn and Encore, was quoted by Radar Online in an internal e-mail saying, “He was being way too obvious moving his money with the count. That’s just crazy! Depending on your blackjack counting strategy, and your preference for cover, you might want a bet spread (low bets vs. high bets) of 1-4 up to 1-12. You might push it to 1-16 if you’re brave. But Ben was betting $100 at the low end, and $10,000 at the high end. That’s a spread of 1-100! He might as well have announced when he sat down, “I’m counting cards!” It was unwise.
Wynn let him play, apparently with a warning. But Hard Rock shut the door.
2. Don’t be tricky with black chips.
According to various sources, Ben was using black $100 chips to keep track of the count. This was wrong for a couple of reasons. Casinos track your black chips. They don’t want you ratholing (sneaking black chips off the table and then claiming you lost money when you really won money). So they’re very aware of how you handle chips. Also, playing at a high-limit table brings extra scrutiny. It’s usually easier to get away with a big spread of 1-12 and ratholing when your bets are $75 to $900 or $150 to $1,800, betting green and black chips at a table in the main casino. Is that boring small stakes for Ben? Probably. But right now his stakes at the Hard Rock are $0. A modest spread of 1-6, $500-$3,000, might have been overlooked if he hadn’t been counting with black chips.
3. Don’t think the scrutiny is only on blackjack
All table games track black chips and higher denominations. They also count greens and reds, but not so carefully. All table games have behaviors that are forbidden or in the gray area of unwanted but not illegal. Some casinos don’t want you setting dice in craps. Some of them don’t want you using visual ballistics or wheel clocking in roulette. Every game has weak points that can be legally exploited, and you shouldn’t imagine that the casino is entirely unaware. So be stealthy. Be cautious. Above all, don’t be greedy. Win a reasonable amount and then quickly go. Don’t pile it up and dare the casino to identify you as an advantage player.Can You Leave A Casino With Chips No Deposit
4. Don’t be a jerk. By all accounts Ben was polite when he got the tap.
But many people are shown the door just because they’re jerks. I once had a guy sitting to my left who was ejected because he made an obscene gesture to me. Why was he angry? I correctly hit my hand and took his good card. The floorman went to the trouble of checking the video to confirm the gesture. Then security came and the dude was tossed. A few months ago I was in a game and one player just couldn’t stop cursing, even after a warning. He wasn’t in a bad mood, just had a foul loose mouth. The female dealer and the women at the table had the guy booted.
5. Don’t imagine you’re Jack McCoy or Perry Mason, but do know the law.
Casinos in Nevada can eject you for almost anything, or nothing. Don’t imagine that legal arguments will sway them. They can ban you from a game or ban you from the property. If you return, it’s trespassing. Elsewhere in the country, the rules are generally similar. In Atlantic City, you can’t be ejected for counting, but a casino can take countermeasures to make the game so unprofitable that it becomes pointless. Your strategic goal is to never reach this situation. And, of course, know the law and the rules of your game. Don’t cheat. Cheaters aren’t ejected; they’re arrested. If you’re detained for legal advantage play but not arrested, stay cool and be polite. Remember that casino security are not police. Don’t answer questions, and firmly repeat that you want to leave, gesturing toward the exits so cameras above can see. Walk out unless you’re physically prevented from doing so. And remember to take your chips! Of course, if it gets to this, then your strategy of stealth has gone horribly wrong. Play well. Be careful. Be gracious, and you’ll avoid getting a tap on the shoulder.

Before giving the answers to what a card counter should do if he is barred, some of which are obvious, let me ask the following question: Are you really going to talk them into letting you stay and play? Are you really going to convince them that if they let you stay, they will see that you are not counting cards? Of course not. There is nothing to do but cash in your chips and leave quietly.
If you are not a card counter, it may be worth it to try to persuade the casino of that fact, because the casinos do actually hassle non-counters who may be winning, or because of a faulty conclusion that you are counting cards. Even non-card-counters, however, do not want to be so adamant that they risk some of the consequences listed below.
If you really think that there may be legal action, brought by you or the casino, try to learn the names of the dealer, pit boss, security people, casino manager, or fellow players. It will be important if there are any further legal proceedings. However, you don’t want to make things worse. Therefore, what shouldn’t you do if the casino is barring you? What Not to Do if You are Barred or Backed Off by a Casino
1. Don’t admit you are a card counter. They don’t know for sure. You might deny that you are a card counter, but don’t get into a big explanation. It doesn’t matter that you bet big off the top of a shoe, or that you’ve been losing your shirt. And you don’t think that you’re going to persuade them to let you continue playing without heat, do you?
2. Don’t wait long enough for your picture to be taken (or for more and better pictures to be taken). High stakes players are more likely to already have a picture on file, but there is no benefit to either the big or small player to have his picture on file.
3. Don’t start an argument, or make a loud fuss. You don’t want to be arrested for being disorderly.
4. Don’t go to the bar and have a drink. You don’t want to be arrested for public drunkenness, or have the casino follow you to the parking lot and tip off the police that you are driving drunk.
5. Don’t go to the cage and cash out. That is the casino’s preferred time and place to snap a good close-up of you. Return to the casino on a different shift, when everyone’s forgotten about you, and cash out your chips quietly.
6. Don’t show your identification, if at all possible. They don’t need it, nor under the typical trespassing statute, do they have a right to demand it. You may have to be very polite in your refusal to show an ID, but you don’t want your name in the Griffin book, which contains photographs and descriptions of card counters, alongside photos and descriptions of cheaters.
If you are actually being arrested, you probably will be legally required to produce identification. Don’t state that you forgot your driver’s license or that you don’t have a license. They may follow you to the parking lot, and tip off the police that you are driving without a license (I’ve learned of an actual incident in which a casino did this). You should merely decline to provide identification rather than making excuses for not having identification.
7. Don’t touch any casino employee. You may find that they may exaggerate the incident and you may end up getting charged with assault and battery, or the equivalent in your state. Don’t let the heat of the moment cloud your judgment. Don’t escalate the tensions. Can You Leave A Casino With Chips WithoutRegarding Confiscation of Chips when Barred
Even though confiscation of your chips should never be legal in the absence of illegal cheating, card counters have had their chips confiscated on occasion, and casinos have refused to redeem their chips on occasion.
Unless the issue is so important to you that you want to become a legal crusader, be practical and prudent. You are on their turf. With rare exceptions, you can’t do better than just getting your money and leaving.
If they confiscate your chips, get a receipt, get the names of everyone involved, ask for the basis of the confiscation (in writing if possible), and leave quietly. Then call your lawyer! ♠

Online Poker Legislation in the US. There is a significant amount of confusion about whether online poker in the US is legal or not. This confusion has not been helped by some sites referring to offshore poker sites as “illegal”, when in fact they are regulated and licensed – only not by authorities in the USA. US online poker laws seem to be changing monthly since government attorneys announced that the Wire Act cannot be used to prohibit states from allowing online poker. Online poker rooms and online gambling sites are clamoring for state licenses, and the US online gambling landscape is going through a major change. Online Gambling is treated differently throughout the country with several states having declared it completely illegal, some have actually legalized it, and others have legislation in the works. Not all types of online gambling are fully legal even in states that do have more or less regulated industries. Outside of states with online poker, most other US jurisdictions don’t have laws in place explicitly making online poker illegal. Online poker has once again become a target in Congressional circles, as the Restoration of America’s Wire Act (RAWA) was reintroduced to the House of Representatives on Wednesday.
As it was last year, the House version of RAWA was introduced by Representative Jason Chaffetz (R-Utah), and would effectively ban most forms of online gambling throughout the United States, including Internet poker.
The bill, which has been backed by Las Vegas Sands CEO and chairman Sheldon Adelson, would reverse a 2011 decision from the Department of Justice which clarified the Wire Act of 1961.
While that law had traditionally been read to ban all forms of remote gambling, the new reading found that it actually applied only to sports betting.
The result was that states were now free to consider regulating online poker and casino games.
Nevada was the first to do so, opening online poker sites, while New Jersey and Delaware went even further, allowing both poker and casino games to be played over the Internet within their borders.RAWA Would Ban Online Poker, Other Casino Games
If RAWA were to pass, it would roll back the law and make it illegal for those states to continue offering online gambling.
It would also impact online lottery sales, though it would not stop online fantasy sports games or horse racing wagers, which are protected by carve outs.
Chaffetz has said that he is “very optimistic” that his bill can pass, which may sound concerning to online poker players. However, most analysts give the legislation a very slim chance of becoming law.
The issue simply isn’t high profile enough to get a large number of legislators behind it, and GOP leaders may shy away from the bill, as there is considerable debate even within their own party as to whether online gambling should be a state issue rather than a federal one.Chaffetz Not Interested in Poker Carve Out
One way in which the bill could slightly improve its chances would be to provide an exemption for online poker, which is seen by many as more palatable than casino games thanks to its skill component.
That’s something that has been championed by Senator Harry Reid (D-Nevada), the former Majority Leader who said that he’d fight for such a carve out if RAWA ever picked up momentum in Congress.
But while that might be a possibility, Chaffetz made it clear that he’s not looking to support a weakened version of RAWA.
“There are some people who would like to see online gaming,” Chaffetz said. “There are some people who would like to see a poker carve out. My message to them is you think online gaming is good, introduce a bill and pass it.”
Defenders of online gambling were quick to react to Chaffetz’s reintroduction of RAWA, saying that the introduction of online poker and other games in three states have proved that Internet gaming can be safe and secure when well-regulated, and that banning such regulations will simply push the games back onto a black market with few consumer protections.
“We know that when policymakers examine the facts they will conclude that an online gaming ban will not only drive an existing black market further into the shadows, but will put consumers and children at even greater risk,” said Allison Siciliano, spokeswoman for the Coalition for Consumer and Online Protection.Related Pages:

Alabama: It’s certainly not a sweet home for gamblers, who face pretty stiff penalties on both the business and player side of the illegal gambling equation. Few regulated options, and likelihood of regulated online poker in near term is essentially nil.
Alaska: State gambling law does not directly handle gambling conducted online. General attitude toward gambling is restrictive, chances of expansion seem quite low. Poker occupies something of a grey area in Alaska law.
Arizona: A litany of regulated options for playing real-money poker coexists with an aggressive stance toward unregulated gambling in Arizona. Internet gambling is directly addressed in state law. Poker handled directly by statute.
Arkansas: Aggressive approach toward prosecuting illegal gambling is aimed primarily at the individuals or groups who are backing, running or otherwise entangled in the business end of the activity. Opportunities for regulated online gambling seem dim.
California: Lawmakers tried to legalize online poker for more than 10 years before quitting after an especially frustrating 2016 legislative session. Many parties made concessions that made online poker appear possible, but a stalemate over a bad actor clause relating to PokerStars ended all talks.
Colorado: Law is clear regarding poker but less so when it comes to the online version of the game. Could be candidate for regulated online poker but lack of obvious support undermines potential. Very tough on unregulated gambling in general.
Connecticut: Tribal gaming is ruled by the Mohegan and Mashantucket tribes, and they want online poker and table games. Lawmakers have been trying to get it done, but the governor and others are concerned about a now-filed MGM lawsuit over an East Windsor casino.
Delaware: One of only a few states in America to legalize and regulate online gambling, including online poker. The sites launched in 2014. The three horse racing tracks offer online poker, which is connected via a multi-state online poker network with Nevada and New Jersey.
Florida: State frequently mentioned as a possible place where regulated online poker could both come to pass and thrive. Current law does not directly intersect with the issue of gambling that happens online. Regulated choices abound for land-based poker players.
Georgia: A very strict approach to any form of gambling underpins the state law of Georgia. Expansion of gambling on any level – live or online – is unlikely under the current law and political climate.
Hawaii: There is no legal gambling in Hawaii, and the state refuses to consider casinos or any type of online gambling or sports betting. Bills have been proposed and then quickly shut down.
Idaho: Gambling isn’t small potatoes in Idaho, where the law takes an expansive approach to defining illegal gambling. While poker may be a question in some states, Idaho law singles it out as a prohibited form of gambling. Online gambling less clear.
Illinois: After long embracing riverboat gambling, Illinois recently added video gaming terminals to its offerings and then land-based casinos in 2019. While the gambling expansion law was broad, it still did not include online poker and online casino games.
Indiana: The Hoosier State offers an above-average amount of regulated gambling – and as a result, has very strict laws on the books to deal with illegal gambling. Law does specifically address online casinos.
Iowa: A state that has been considering regulated online poker for several years, Iowa takes a middling stance on gambling that takes place in unregulated environments. Penalties for operators can be quite harsh, less so for poker players.
Kansas: Online gambling is not covered directly by state gambling law. While Kansas is home to a wide array of regulated ways to gamble, online gambling does not seem likely to appear on that menu at any point in the near future.
Kentucky: State took a harsh stance on internet gambling in 2008 by seizing more than 140 gambling domains and eventually suing PokerStars for $870 million. PokerStars won the lawsuit in the Court of Appeals but state could take it to Kentucky Supreme Court. Attorney General pushed for legal online poker in 2018 and now-Governor Beshear working to make it happen, along with sports betting.
Louisiana: The state law is complicated by a flawed and incomplete definition of gambling. All parts of the law are subject to interpretation. There was an effort to legalize online poker by voter referendums, but nothing has moved on it since 2018.
Maine: Nothing in state law provides precise guidance on the matter of playing poker online. Other types of poker legal under specific circumstances, but players do not appear to risk arrest regardless of legal status of the game they take part in.
Maryland: One of the more complex webs of state gambling law thanks to additional level of county law with regards to gambling. State has pursued multiple online gambling operators aggressively. Position on players less clear.
Massachusetts: Gambling-friendly state started seriously considering online poker and casino games in 2017, opening first land-based casino in 2018. No serious online gambling bills proposed in 2019 or 2020 but state remains a strong possibility in coming years.
Michigan: Legislature legalized online poker in 2018 but then-Governor Snyder vetoed it. Similar legislation moved in 2019 with changes ultimately coordinated with now-Governor Whitmer. Online poker and casino games legalized in late 2019 but without interstate network possible for now. Sites likely to launch in early 2021.
Minnesota: Many ways to play poker legally in the state, but also many questions about how the law applies to gambling that takes place online. Law unclear both on the issue of Internet gambling in general and Internet poker specifically.
Mississippi: Law is quite clear on the matter of poker as a form of gambling; poker is included in the statutory definition of the term in Mississippi law. Some past rumblings regarding the regulation of online poker have – to date – amounted to nothing in the way of tangible action.
Missouri: Very severe punishments for all parties involved in illegal gambling. No part of the law mentions online gambling by name, nor have legislators shown interest in clarifying the law regarding online poker or other forms of online betting.

Nebraska: Online poker seems unlikely in coming years, but Nebraska lawmaker proposed legal live poker in 2020 as a skill game. Law not garnering much support but movement is possible.
Nevada: No surprise that the nation’s gambling capital was the first to offer regulated online poker. However, only one site is available for players in the state. Online casino games are not permitted.
New Hampshire: Poker relegated to legal limbo thanks to vague definition of gambling on New Hampshire’s books. Online gambling exists in similar state by a literal reading of the law, which doesn’t meet the issue directly at any point. Regulation of online possible, but not uniquely likely.
New Jersey: As one of the pioneers of regulated online gaming in the US, New Jersey has seen more than $1B in revenue from those games in the last 5+ years. Success has spurred land-based casinos into profitable territory. Sports betting is now legal in NJ, too.
New Mexico: State does allow some regulated forms of real-money poker, but all unregulated forms are potentially subject to New Mexico’s anti-gambling laws. Online poker players will find no specific mention of their game on the books, but other laws may still apply regardless.
New York: Years of efforts to legalize online poker failed to materialize, with House support not matching that in State Senate. Online poker seemed more unlikely in 2019 but lawmakers introduce bills yearly. May become more of a focus after online sports betting is legalized.
North Carolina: Like its twin to the south, North Carolina takes a dim view of nearly all forms of gambling. Unlike South Carolina, the law in North Carolina offers little risk to players in illegal gambling games. Poker likely, although not definitively, included in statutory definition of gambling.
North Dakota: Online gambling regulation could advance in the state in the short term, but is far from a sure thing. Current gambling laws are quite harsh in theory, and list of permitted gambling outside of directly regulated activities is narrow.
Ohio: As regulated gambling advances in the Buckeye State, so have the chances that online poker will join the list of explicitly endorsed gambling options. Many forms of poker already clearly legal in state, but unregulated forms could run afoul of Ohio law.Online Poker Ban Us Citizens
Oklahoma: Existing laws aimed at cracking down on sports betting may apply to wagering over the Internet, but that is but one of many conclusions you might reach after reviewing the law regarding gambling in Oklahoma. Chances for regulated online poker in near term are exceedingly slight.
Oregon: State takes rigid approach to gambling that includes a law banning financial activity related to online gambling. Unclear whether poker players are included under the scope of the law. Legal poker available in several land-based formats.
Pennsylvania: Years of consideration finally led to legalizing online poker and casino games, also sports betting, in 2017. Online casinos first launched in mid-2019 and one online poker site (PokerStars) opened in late 2019. Others expected to follow in 2020.
Rhode Island: Another US state with an excessive amount of vague definitions and statutes regarding gambling. Despite the lack of clarity, punishments for players appear fairly minor. Poker may or may not be treated uniquely from other forms of gambling.
South Carolina: Often employed as a poster child of sorts for the outdated – some would say antiquated – approach of state law toward gambling. Laws are written in such a way as to potentially render playing any game of any sort an illegal act, even if no wagering is involved.
South Dakota: It’s explicitly illegal to operate an online betting website or similar business in South Dakota. What’s less clear is how poker players merely engaging in online poker games fare under South Dakota’s gambling law.
Tennessee: Despite a prohibitionist approach to gambling that is outdone only by Utah and a handful of similar states, Tennessee does not have any law on the books that offers a precise legal status for online gambling.
Texas: The state that lent its name to the most popular form of modern poker has little interest in or legalizing the game. Poker remains technically illegal, both online and live, but poker room operators have found loopholes and opened private poker clubs throughout Texas. Lawmakers have yet to address issues currently in courts’ hands.
Utah: The only state to decide to pass a law essentially forbidding any participation in any sort of federal online gambling network. Few – some would argue no – types of gambling can be conducted legally in Utah.
Vermont: State gambling laws reflect the larger attitude of Vermont toward individual freedoms. While some laws on the books forbid particular acts related to gambling, the charges (and interest in enforcement) appear to be far less intense than the typical state.
Virginia: Virginia has yet to commit to a specific legislative approach to online gambling. Existing laws regarding land-based gambling may apply. Poker players left with something of a mixed bag in Virginia.
Washington State: In theory, the absolute worst state for online poker players as participating in a real-money game online appears to merit a felony charge. Future of online gambling in the state constantly in flux. Multiple regulated options for poker exist.
West Virginia: After expanding land-based gambling with ease, lawmakers finally saw fit in 2019 to legalize online poker and casino games for regulation. Operators are expected to obtain licenses in 2020 and potentially launch their sites in 2021.
Wisconsin: Poker players can legally play real-money poker in a variety of ways. State law lacks absolute clarity regarding the online variant. Overall legal approach to gambling is fairly strict, thanks in part to protections built in for the state-approved gambling outlets.
Wyoming: Few regulated gambling options available except on tribal reservations. Lawmakers considered bills in 2020 for online sports betting and legal games of skill but far to go for expanded poker on any level.

In this article, we’ll clarify the latest stance of the legislative authorities on betting and gambling laws. We’ll answer the following questions:Is gambling legal in India?
It’s a tough question to answer. The Indian government’s outlook towards gambling and betting remains in a grey area. A few sports revel in complete approval from the authorities while other (though sharing the exact same characteristics) are completely shunned.
Horse racing and rummy are considered games of skill and thus free to bet on, while cricket and poker don’t share the same distinction in the eyes of Indian lawmakers.
Poker is a major grey area in Indian law. It’s quite interesting that games such as Teen Patti (flush) and Texas Hold ’em are banned while Rummy is allowed. The answer is the Seventh Schedule of the Constitution of India which explicitly gives states the right to legislate and make policies related to “gambling and betting”. It is quite clear in the Seventh Schedule Entry 34 List II which says states could legalize gambling should they choose to do so.
Every state government is free to enact as well as legislate gambling laws as per their discretion. Also, the Central Government cannot intervene in any of the state proceedings.
To date, most Indian states have only made laws against gambling, while 13 states have legalized lottery, and two states (Goa and Sikkim) have legalized many other forms of gambling. With a country as diverse as India and 29 separate states, you can only imagine the variance in gambling laws.

Goa has made two amendments to the Goa, Daman and Diu Public Gambling Act, 1976 to legalize certain forms of gambling. The relevant section from that act is listed below:

The primary legislative document that makes gambling in India a ‘grey’ legality is the Public Gambling Act. This is an old law created during British rule. This 145-year-old law makes operating a gambling house, assisting in the operation of a gambling house, visiting a gambling house (whether gambling or not), financing gambling and being in possession of gambling devices a crime. The penalty is a fine not exceeding 200 rupees or up to three months in prison.
The Public Gambling Act explicitly states “nothing in this Act shall apply to games of mere skill wherever played” which means, in absence of other laws against them, wagering on games of skill is legal. The competitions where success depends on a substantial degree of skill are not “gambling” and despite there being an element of chance if a game is preponderantly a game of skill it would nevertheless be a game of “mere skill”.Payment and Settlement Act, 2007
Madame President Patil signed the Payment and Settlement Systems Act, 2007 on 20th December 2007 and it went into effect on 12th August 2008. This act gives authority to the Reserve Bank of India (RBI) to regulate all forms of electronic payment. Section 4 is key which in part states:
Payment system not to operate without authorization: (1) No person, other than the Reserve Bank, shall commence or operate a payment system except under and in accordance with an authorization issued by the Reserve Bank under the provisions of this Act:
The act goes on to say any payment system or clearing house with less than 51% of the equity held by an Indian bank requires authorization to operate in India. Much the rest of this 14-page Act, gives RBI all sorts of authority over all aspects of payment processing in India, as well as the rights to enter and inspect with or without notice and access to all financial and customer data upon request.
The most important factor here is RBI has the right to make policies almost on demand (in concordance with this Act) for all things involving payment processing. They have exercised this authority numerous times. This is what caused the PayPal in India fiasco, and also what caused Neteller to stop issuing Neteller plus cards, and EntroPay to stop issuing Plastic MasterCard branded debit cards. So, in short, RBI has the full right to instruct banks to decline or refuse and payments or deposits involving any particular payment processor, e-wallet or clearing house. While they seem more concerned with going after businesses and freelancers who might be evading tax, should they in the future decide to go after gambling processors, the legal framework and authority for them to do so already exists? Again, to be clear, at the current time this does not seem to be a priority for them.Information Technology Act, 2000
On 14 April 2011, the Gazette of India published the Information Technology (Intermediaries guidelines) Rules, 2011. This legal document is issued under authority granted in Information Technology Act, 2000. In short, this act instructs Internet Service Providers and Website Hosts, to block access to certain types of websites and content. While the majority of this is for areas of National Security, things that would shine India in an improper light, things that are blasphemous, illegal, pornographic etc., Section 2 item B includes anything “relating or encouraging money laundering or gambling”.
The addition of gambling to the IT Act of 2000 is in conflict where much the rest of India is headed. Again, the Sikkim Government has legalized sports betting and casino gambling, Goa has legal casinos, and 13 states have legalized lottery. Even Mr. Haroon Lorgat, the CEO of the International Cricket Council (ICC), has urged Indian officials to make cricket betting sites legal, as he feels this is the best way to prevent corruption and match-fixing in the sport. So while the push for legal gambling in India is strong and has made some progress, the Central Government is still taking action in an attempt to make it more difficult.
At the current time – most gambling in India is illegal. However, legal gambling does exist for horse racing, lottery, and rummy (paplu). There is also a high number of betting sites legal in the UK which service Indian players with only minor hassles. The law at this time seems more concerned with scaring Indian players not to gamble than it does to prevent it. The Central Lotteries (Regulation) Act of 1998 gave state governments the authority to hold lotteries but stipulated this was restricted to a maximum of one draw per week. Today in most Indian states there are lottery terminals excessively available and some lotteries are drawn every 15 minutes.

After the 2013 match-fixing scandal in IPL, the Lodha commission was appointed by the Supreme Court to look into the matter of legalization of cricket betting. In July 2015, the Patiala High Court discharged all 36 people accused in the Spot-fixing scandal. Judge Neena Badal adjudged that cricket betting is not illegal and therefore no action can be taken for betting on cricket matches.
In August 2017, the Delhi Police filed an appeal against the discharge order. Also, in 2016, an order passed by a division bench of the Supreme Court recommended: “recommendation of legalizing betting involves the enactment of a law that may be examined by the Law Commission and the Government for such action that it deems fit”.
In June 2018, the law commission submitted a recommendation to the government favouring the legalization of betting in India under stringent control to curb money laundering. The Commission inferred that since it’s almost impossible to completely ban cricket betting in India; regulating cricket betting and gambling under stringent laws is the correct course of action.
The law commission suggested that as per Articles 249 or 252 of the constitution, the government has the power to formulate laws for regulating gambling. In case the legislation is made under Article 252, non-consenting states would be free to adopt them as well. This would help the states work around years of red tape.
Though we get a sense that India is moving towards legalization of cricket betting, it still remains to be seen when exactly the government takes a concrete decision!Is Betting on Horse Racing Legal in India?
Horse racing and gambling go hand-in-hand in India. It is one of the few sports in which gambling has been legalized and there are clear-cut laws in place. Many times, the legality of horse race gambling has been challenged in the courts as well the Supreme Court.
As discussed in earlier sections, states have the option of enacting the Central Public Gaming Act of 1867 or ratify their own Gaming Acts and statutes.Provisions in State Gaming Acts
Currently, there are eight state legislations which have enacted specific statutes on the legalization of horse racing betting. The states of Delhi, Maharashtra, West Bengal, Karnataka, West Bengal, Andhra Pradesh, Tamil Nadu, and Meghalaya have passed rulings allowing betting on horses in licensed race courses.

In the landmark case of Dr. KR Lakshmanan v. State of Tamil Nadu, a three-judge bench of the Supreme Court of India ruled favourably on the legality of betting in horse racing.
In this important ruling, the Supreme Court explicitly ruled that horse racing is a game of skill and not chance; therefore, it’s legal to bet on horse racing. Sadly, though this ruling by the apex court of India is excellent news for horse racing; at the same time, there is a gamut of sports like poker, cricket, fantasy sports, blackjack and rummy which deserve a similar ruling based on their preponderance to skill than luck.Regulatory Authorities on horse racing in India

In a letter obtained by 7 Action News to employees, MGM Grand Detroit President and COO David Tsai said they will suspend operations at 5 p.m. on Monday, March 16.
’We expect to remain closed for at least two weeks, and we will be working with the MGCB to reevaluate when we can reopen for business,’ the letter reads.
The casino confirmed the news shortly after in a statement on social media.

While some states have maintained an unambiguous stance over playing online games on their premises, others have strictly prohibited betting in any form within their boundaries:

Although the game of skill is not considered as gambling, the district court of Delhi observed that when skill-based games are played for money in virtual space, the same would be regarded as illegal as the degree of manipulations increase in the virtual area.
Central legislation must uniformly distinguish and regulate the online game of skill and gaming on the online platform.
There persists the requirement of Central legislation to uniformly distinguish and regulate the online game of skill from gambling on the online platform.
Online gambling laws in India are vague and open tointerpretation. Ask 50 different people about the legality ofbetting in India and you’ll get 50 different answers. On thispage, we’ll attempt to give you a thorough but concise overviewof the current legal situation.
Gambling is regulated in India at the national and statelevels. On the national stage, gambling is mostly addressed bytwo or three acts depending on who you ask:
*The Public Gambling Act of 1867
*Prize Competition Act, 1955
*The Information Technology Act of 2000 (maybe)
Online gambling isn’t specifically mentioned in any of theseacts so it resides in a grey area of the law. Some could arguethat the Public Gambling act of 1867 applies to online gamblingsince it restricts all forms of “gambling.” Additionally,there’s the problem that “gambling” itself is never defined bythe act.
The states also have the authority to regulate gambling to adegree. Two states, Goa and Sikkim, have authorized a limitednumber of brick-and-mortar casinos. The other states outlaw mostforms of gambling, betting, and poker. The one nationwideexception is horse racing betting, which the Supreme Court ruledwas a game of skill in 1996.
Although most forms of real-world gambling are banned inIndia, there are no legal means for prosecuting those who chooseto place their bets online. For that reason, India is afast-growing market for online gambling. With 1.2 billioninhabitants and a growing middle class, India shows greatpotential for e-gaming operators.
Offshore betting sites such as Bet365 have already enteredthe market and cater to Indians. At Bet365, you may deposit withIndian rupees and are welcomed to register and play all gamesfrom India. Bet365 resides outside of India and is thereforesafe from the laws that ban the operation of gambling websites.And since there are no laws that prohibit individual people fromplacing bets online, Bet365 is able to take advantage of thelegal loophole.India Gambling Online LawsThe Public Gambling Act of 1867
The Public Gambling Act of 1867 made it illegal to run agaming house or be found in one. The act describes a gaminghouse as “any house, walled enclosure, room or place, playing orgaming with cards, dice, counters, money or other instruments ofgaming or is found there present for the purpose of gaming,whether playing for any money, wager, stake or otherwise.” Thepenalty for being caught in one is up to a month in jail.
This act predates the internet by well over a hundred yearsso there’s a good deal of debate as to whether or not it appliesto online gambling. Does a website count as a “place” whereinstruments of gaming are present? It depends on who you ask.
Further complicating matters, an amendment in 1976 added thefollowing text:“In section 6, for the words “house, walled enclosure, roomor place” wherever they occur, the words “house, room, tent,enclosure, space, vehicle, vessel or place” shall besubstituted.”Online Gambling Laws In India
The question remains: does the internet count as a “vehicle,vessel or place?” The 1976 amendment also predates the internet,but it could be interpreted as applying to the internet.
Additionally, there’s no ironclad definition of the word“gambling.” The closest the Public Gambling Act of 1867 comes todefining “gambling” is in section 12:“Act not to apply to certain games.—Nothing in the foregoingprovisions of this Act contained shall be held to apply to anygame of mere skill wherever played.”Prize Competition Act, 1955
The Prize Competition Act, 1955 seems to address a veryspecific type of gambling, but it has been interpreted asapplying to all forms of gaming in which a prize is awarded. Inshort, the act bans prize competitions in which the prizesexceed a thousand rupees a month.
The act defines “prize competition” with the following text:“‘prize competition’ means any competition (whether called across- word prize competition, a missing- word prizecompetition, a picture prize competition or by any other name)in which prizes are offered for the solution of any puzzle basedupon the building up, arrangement, combination, or permutationof letters, words, or figures.”The Information Technology Act of 2000
The Information Technology Act of 2000 is even more difficultthan the other two acts described above, because it’s so broadin scope. This act still causes a great deal of controversytoday due to its vague wording and harsh punishments for a widerange of infractions.
Like the other two acts on this page, the InformationTechnology Act doesn’t specifically mention online gambling.However, the following text could be interpreted to apply tointernet wagering. No internet betting cases have yet to betried under the act, so we don’t yet know if it applies togambling or not. We will have to wait and see.
The most controversial portion of the act is also the partthat may or may not apply to online gambling:“Sending offensive message through electronic means – Sendingany information through an electronic message that is grosslyoffensive or has menacing character and might cause insult,injury, criminal intimidation, enmity, hatred, or ill will, etc.or sending such mail intended to deceive or to mislead theaddressee or recipient about the origin of such messages”
A violation of this portion of the act may result inimprisonment for up to three years and an unspecified crime. TheBombay High Court has already ruled that this act can be appliedto content published on websites.
Could online gambling be considered a message that may causeinsult, injury, or ill will? Does it fall under the comically vague“etc.”? We don’t know. So far, we have yet to read about anyonebeing charged with placing bets under the law.What This All Means
In summary, gambling laws in India are confusing, poorlywritten, and haphazardly enforced. The reality of it all foronline gambling specifically is that people across India betonline every day. There are no laws that criminalize the mereact of placing a few bets online. If you live in India, you haveaccess to a wide range of internet casinos, sportsbooks, andpoker rooms.
There’s no reason to limit yourself from enjoying theexcitement and convenience provided by gaming websites. In mostlocations, betting over the internet is safer than doing it inperson. Millions of Indians already gamble online and have hadno legal issues to date.
The one bit of caution we would recommend is to look into thelaws in your area. Indian gaming law makes little sense and isenforced at random. You should always check with the localauthorities before you place real money bets anywhere.

On Sunday, a gambler at the Seminole Hard Rock Casino in Tampa was playing a $4 slot machine when its bells started ringing and an enormous figure began flashing on its jackpot screen: $166,666,666.65. Bill Seebeck thought he was set for life.
Alas, ’twas not to be. After investigating the win, casino officials told him that the machine had malfunctioned and he wouldn’t be receiving a cent. The maximum jackpot on the machine is a relatively paltry $90,000- and the gambler wouldn’t get that payout either. They even attempted to coerce Seebeck into agreeing to that in writing, but he refused.
It’s not the first time the Seminole tribe has pulled a similar gambit. In 2007, a Sunny Isles man was playing the slots at Seminole Hard Rock Resort & Casino in Hollywood when it appeared that he hit a jackpot worth more than $259,000. He was even given an oversized check for the amount- before casino officials attributed the win to a ’computer glitch’ and told him he would not be paid. After the story hit was reported in the news, the tribe decided to pay the full amount.
Seebeck probably shouldn’t hold his breath for a similar reversal concerning his own enormous jackpot- although you can’t blame him for trying. From an ABC news report: I Support

The Seminole Hard Rock Casino Tampa has made an offer to William Seebeck, and he has accepted, recognizing that the slot machine he was playing on Sunday malfunctioned, in what can be best described to the layman as a ’computer glitch.’ The maximum payout on the Ultimate Party Spin machine played by Seebeck is $99,000, although his bet of $1.50 at the time of the malfunction could have generated a maximum payout of only $2,500, with the right combination. Enchant - 8 Agi, 8Str, or 100 HP.Raging Berserker’s HelmThis is pretty much the bost item for your head slot and easily obtainable to boot.Expert Goldminer’s HelmetMuch harder to obtain but you get expertise. 2.8595 reduced chance to be dodged/parried I believe.However you lose a significant amount of AP and crit.Shoulder slot.Skeletal ShouldersSame as Herod’s shoulders except they look worse and have 3 more armor.Herod’s ShoulderA solid pair of shoulders, nice stam, some sta and armor.Fleshhide Shoulders100 less armor and 1 less str than Herod’s but 6 agi in place.Revelosh’s Spauldersof the Bear or MonkeyNice amount of sta on these, I’d take Fleshhide over these though.Flintrock ShouldersNot all that great in my opinion, offers less stam than your other options but more agi.Back slot. Enchant - 12 Agi.Scorpashi CapeGet it. Use it. Love it.Battlehard CapeHorde only. Not bad if you cant find a Scorpashi Cape.Darktide CapeAgain, alterative if you cant get a Scorpashi Cape. Best stats and you’re able to put the TBC enchants on these.Highlander’s/Defiler’s Mail GreavesStill have decent stats at 39 but you’re unable to put TBC enchants on these.Ironheel BootsAlli only. Quested and TBC enchantable. Ring slots.Aquamarine Signet of the Bear/Monkey.Best ring you can get but you can only have one even if they are different suffixes.Legionnaire’s/Protector’s BandThis should be in your second ring slot.Truesilver Commander’s RingIf you’re saving marks for a tabard or something else this will hold you over till WSG ring.Neck slot.Medal of CourageNice amount of AP and stam. Questable by both factions.Scout’s/Sentinel’s MedallionAnother solid option for a neck pice.Trinket slots.Arena GrandmasterBest twink trinket, hands down. Not all that easy to get though and takes some time.Insignia of the Horde/AllianceThis should be your second trinket unless you are a human. You can switch this out while it’s on CD though.Mark of the ChosenNice litle stat boost, low chance though.Philosopher’s StoneAnother option. +5 all stats.Black Pearl PantherJC only. 90 AP on use, 5 min CD.Golden HareAnother JC only. Increased run speed(removes the need for speed increase on boots) and run speed/snare prevention use. 20 min CD.Tidal Charm3 sec stun on use. Nice for catching casters and EFC. 15 min CD.Rune of DutyAnother option with decent passive bonuses.2 Handers. Enchant - Crusader, Savagery, or 35 agil.NightbladeThe only advantage here is the DPS of the weapon.Pendulum of DoomA very slow axe, very nice. Alot of people will pay ALOT of money for this though.Be prepared to pay for a good portion of someone’s epic flyer to get this, or use another weapon. =PBonebiterAlli only. Nice stats, slower than other options here.X’caliboarAlternative to Nightblade. Almost the same median dmg but better stats and slower.Lumbering Ogre AxeVery slow green axe. A good alternative to Pendulum of Doom.Whirlwind WeaponsAxe is decent though not as good as other options.Mace is good if you’re set on going mace spec.Sword however, is same speed as Nightblade so there’s not really any advantage there.One Handers. Enchant - Crusader MH. Potency or Mongoose OH.Vanquisher’s Sword28 AP, pretty much same DPS/speed as SM quest reward swords.Sword of Serenity/OmenSerenity(Alli only) has a good amount of stam. Omen(Horde only) faster than most other swords, nice stats. Either of these could replace Vanquisher’s/Dazzling.Dazzling LongswordFast sword, decent proc. Good OH.Legionnaire’s/Protector’s SwordNice MH sword. Slow with high median dmg.Stonevault BonebreakerVery nice maces. If you feel like DW’ing and going mace spec these would be the way to go. Ranged.Monolithic BowBest stats, get one when you can.Outrider’s/Outrunner’s Bowsome Agi/sta. Decent alternative.The SilencerAnother alternitive if you want AP instead.Shield. Enchant - 18 Stam.Aegis of the Scarlet CommanderIt’s the best shield for the bracket and drops in SM. Spamstring in glyph form.
